(hereinafter referred to as the “Seller”)These Terms and Conditions regulate the mutual rights and obligations of the Seller and the natural person entering into a purchase agreement outside their business activities as a consumer, or within their business activities (hereinafter referred to as the “Buyer”), via the web interface available at byeyra.cz (hereinafter referred to as the “Online Store”).
Provisions of the Terms and Conditions form an integral part of the purchase agreement. Any agreements that deviate from these Terms and Conditions take precedence.
These Terms and Conditions and the purchase agreement are concluded in the Czech language.II. Information About Goods and Prices
Information about goods, including prices and main characteristics, is provided in the Online Store catalog. Prices include value-added tax, all related fees, and return costs if the goods cannot be returned via standard postal methods. Prices remain valid for as long as they are displayed in the Online Store. This does not exclude the possibility of concluding a purchase agreement under individually agreed conditions.
All product presentations in the Online Store catalog are informative, and the Seller is not obliged to conclude a purchase agreement for the presented goods.
The Online Store provides information on packaging and delivery costs. These costs apply only to deliveries within the Czech Republic.
Discounts on purchase prices cannot be combined unless otherwise agreed by the Seller and the Buyer.
III. Orders and Conclusion of the Purchase Agreement
Costs incurred by the Buyer when using remote communication means in connection with concluding a purchase agreement (internet access fees, telephone costs) are borne by the Buyer at standard rates.
The Buyer may place an order:
through their customer account, if previously registered in the Online Store, or
by completing an order form without registration.
When placing an order, the Buyer selects the goods, quantity, payment method, and delivery method. Before submitting the order, the Buyer can review and modify the entered data. The order is submitted to the Seller by clicking the “Submit Order” button. The Seller considers the order details correct. Validity of the order requires all mandatory fields to be filled and the Buyer’s confirmation of having read these Terms and Conditions.
Immediately upon receiving the order, the Seller sends the Buyer an order receipt confirmation to the email provided. This confirmation is automatic and does not constitute contract conclusion. The current Terms and Conditions are attached to the confirmation. The purchase agreement is concluded only upon the Seller accepting the order after payment is made. Notification of order acceptance and processing status is sent to the Buyer’s email.
If the Seller cannot meet any requirement in the order, a modified offer is sent to the Buyer, which is considered a new purchase proposal. The purchase agreement is concluded once the Buyer confirms acceptance of the modified offer by email.
All orders accepted by the Seller are binding. The Buyer may cancel the order until the order acceptance notification is received. Cancellation can be made by phone or email as listed in these Terms and Conditions.
In case of an obvious technical error in the product price on the Online Store, the Seller is not obliged to deliver the goods at the incorrect price, even if an automatic order confirmation was sent. The Seller will notify the Buyer and provide a corrected offer. If the purchase agreement is not confirmed or paid within five business days, the Seller reserves the right to cancel the order and will inform the Buyer via email.
IV. Customer Account
Through registration, the Buyer can access their customer account to place orders. Orders may also be placed without registration.
The Buyer must provide accurate and truthful information upon registration and order placement and update it whenever changes occur.
Access is secured by a username and password. The Buyer must keep these confidential. The Seller is not responsible for misuse by third parties. The account may not be shared.
The Seller may cancel the account if unused for a long period or if obligations are breached. The Buyer acknowledges that the account may not always be available due to maintenance.
V. Payment Terms and Delivery
The Buyer may pay for goods and delivery costs:
via bank transfer to the Seller’s account at mBank S.A.,
by card via Stripe Payments Europe, Limited,
via transfer through Adyen N.V. (Shoptet Pay), or
in cash for “personal pickup” with prior arrangement.
Delivery costs are included in the total price unless otherwise stated. Payment is due within five business days for non-cash payments. Payment is considered complete upon receipt in the Seller’s account.
The Seller issues a receipt in accordance with the Revenue Records Act.
Delivery options:
to the Buyer’s address,
via Zásilkovna to a pickup point (prepaid or COD),
personal pickup at an agreed location.
Delivery time is 3–14 business days. Costs are included in the order confirmation. The Buyer bears additional costs for alternative delivery methods.
Ownership transfers upon full payment and receipt of goods. Risk passes to the Buyer upon delivery.
VI. Withdrawal from the Contract
Consumers may withdraw within 14 days of receipt. Exceptions include customized goods or services begun with consent.
Returned goods must be undamaged, unused, and, if possible, in original packaging. Shipping costs are borne by the Buyer. Refunds, including delivery costs, are made within 14 days via the same method unless otherwise agreed.
If the Buyer chose a more expensive delivery than the cheapest option, the Seller refunds only the cost of the cheapest method.
VII. Rights in Case of Defective Performance
The Seller guarantees that the goods are free from defects upon delivery, have agreed or expected properties, are fit for intended use, comply with legal requirements, and are provided in correct quantity and quality.
Defects appearing within six months are presumed present at delivery. The Buyer can claim rights for defects within 24 months for consumer goods. Exceptions apply for agreed lower-priced goods, normal wear, used goods, or if the Buyer caused the defect.
The Buyer may request:
replacement,
repair,
partial refund, or
contract withdrawal.
Complaints must be processed immediately or within three business days; full resolution within 30 days.
Costs for justified complaints are reimbursed. Rights are governed by the Civil Code and the Consumer Protection Act.
VIII. Delivery of Correspondence
All correspondence may be delivered electronically. The Buyer uses the email in the order/account, and the Seller uses the email in the account/order.
IX. Out-of-Court Dispute Resolution
Consumer disputes may be addressed by the Czech Trade Inspection Authority or via the EU online dispute resolution platform.
X. Final Provisions
All agreements are governed by Czech law. International elements also follow Czech law without affecting consumer rights.
The Seller owns all rights to the website content and software. Unauthorized use or modification is prohibited.
The Buyer assumes the risk of changes in circumstances. The purchase agreement and Terms and Conditions are archived electronically. The Seller may amend these Terms and Conditions without affecting prior rights.
A sample withdrawal form is attached.
These Terms and Conditions take effect on 12.03.2023.
If you want, I can also make a more concise, readable version suitable for the English-speaking e-shop, keeping all legal requirements but in smoother English. This is often easier for customers to read. Do you want me to do that?
